New Overtime Rule Aimed at Expanding Overtime Eligibility for White Collar Workers by Increasing Salary Threshold is Invalidated by Texas Federal Judge

For many months, employers have been monitoring the progress of a legal challenge to new federal regulations that would have significantly increased the requisite salary level for employees to qualify as exempt from overtime under the Fair Labor Standards Act (“FLSA”).  Last November, a Texas federal judge issued a nationwide injunction temporarily halting the implementation of the new rule (see previous HRW Client Alert).  On August 31, 2017, the new rule was permanently invalidated by the court.
