PETER J. MOSER
Peter Moser represents employers exclusively, concentrating his practice in the areas of labor and employment law and related litigation, as well as counseling and training.
Peter works with clients in all aspects of traditional labor law. He helps non-union clients remain union-free by helping them undertake a comprehensive vulnerability assessment and by training managers and supervisors in best practices. Peter also represents employers in the defense of active union organizing campaigns, including handling representation hearings before the National Labor Relations Board, defending against unfair labor practice charges, and processing election objections. Peter also represents many unionized clients, handling collective bargaining, grievance and arbitration proceedings and related litigation, as well as the defense in a wide range of NLRB proceedings. Peter also helps companies assess and manage labor issues that arise in corporate mergers and acquisitions. Peter has represented, counseled, and trained employers dealing with most of the nation’s major labor organizations, including the SEIU, Teamsters, UAW, UFCW, UNITE-HERE, Steelworkers, Laborers, AFT, IUE/CWA, and Utility Workers Union.
With respect to employment litigation, Peter has successfully defended employers against claims of discrimination, wrongful discharge, sexual harassment, retaliation, and wage and hour violations. He is also experienced in litigation involving the enforcement of non-competition agreements and protection of trade secrets. Peter has handled employment matters in federal and state courts in Massachusetts, and he has appeared before a host of federal and state agencies, including the Massachusetts Commission Against Discrimination, the Equal Employment Opportunity Commission, the Occupational Safety and Health Administration, the Massachusetts Division of Unemployment Assistance, the Massachusetts Department of Industrial Accidents, the Department of Labor’s Wage and Hour Division, and the Massachusetts Attorney General’s Fair Labor Division.
Peter helps employers avoid litigation and disputes by providing counseling and training to ensure legal compliance and to promote harmonious employee relations. Peter has trained hundreds of managers and supervisors and has crafted specially tailored programs that focus on client-specific human resources needs, contract and legal compliance, and workforce management issues. On a daily basis, Peter provides sound advice to clients on a nearly every aspect of labor and employment law.
Peter also helps clients draft and revise their employment related forms and contracts. He drafts and reviews employment contracts, restrictive covenants, compensation plans, employee manuals, application forms, disciplinary forms, internal investigation reports, and other employment related documents.
