DAVID B. WILSON

Dave Wilson has spent over two decades litigating wage and hour, employment, real estate, maritime, and general commercial disputes in the state and federal courts of Massachusetts and New Hampshire. He defends employers in related administrative proceedings before the MCAD, the New Hampshire Human Rights Commission and federal and state agencies on matters ranging from wrongful termination, sexual harassment, workplace violence, privacy, discrimination and defamation to wage and hour disputes.

Dave spends a significant amount of his time acting as a business partner with his clients, counseling and training them in all areas of employment relations law.  Dave also has an acute interest in the intersection between technology, the law and the workplace and has written and presented extensively on social media and hidden cameras in the workplace.  He is a MCAD certified trainer in Preventing Harassment in the Workplace and Preventing Discrimination in the Workplace and has served on the faculty for the MCAD certification course.

Dave is a member of HRW's Data Security Team, which was formed to develop a comprehensive approach to the new data security statutes and regulations (M.G.L. ch. 93H, 93I, 201 C.M.R. 17.00, et seq.).  including developing programs for compliance, speaking and training on the subject, and monitoring and participating in relevant legislative activities.

EMPLOYMENT COUNSELING AND TRAINING

  • ongoing two day manager training for a public utility company employing over 3,000 people in eastern Massachusetts.
  • Conducted employment law training for a multibillion dollar public utility company with over 1600 employees in Boston, southeastern Massachusetts, Cape Cod, and the Islands.
  • Advised large technology research firm and manufacturers in connection with layoffs, plant closings, including disparate impact analysis and preparation of severance agreements and WARN notice requirements.
  • Providing regular advice and representation to technology research firms that have hired employees that have been alleged to be bound by noncompetition or other agreements with their former employers.
  • Worked with an internationally based information technology publishing company in the creation of its "Non-Disclosure, Non-Competition, and Non-Solicitation Agreement."

BUSINESS and COMPLEX LITIGATION

  • Virginia Diranian, Administratrix v. Michael Diranian, Administrator 55. Mass. App. Ct. 605 (2002).
    Successfully represented estate of deceased real estate business partners to obtain property held as joint tenants with rights of survivorship.
  • Cellco Partnership v. Town of Douglas, 81 F. Supp. 2d 170 (U.S.D.C. MA 1999)
    Successfully represented wireless carrier in obtaining approval for siting of tower.
