Important New Developments Related to Criminal Background Checks HRW has issued a Legal Alert to inform employers of important developments related to the use of criminal background information for employment purposes, specifically:  (1) CORI Reform provisions that will go into effect on May 4, 2012, and (2) the EEOC’s recent release of  an Enforcement Guidance regarding use of arrest and conviction information.  Click HERE for a copy of the Alert. 

NLRB Posting Rule Put on Indefinite Hold In August 2011, the National Labor Relations Board (NLRB) issued a final rule requiring most private-sector employers – even those who are not unionized – to post a notice informing employees of their rights under the National Labor Relations Act (NLRA).  The rule was set to go into effect on April 30, 2012.  On April 13, 2012, the U.S. District Court for the District of South Carolina struck down the notice-posting rule in its entirety.  As a result, the D.C. Court of Appeals has issued an order prohibiting enforcement of the rule while the appeal is pending.  Oral arguments are scheduled for September 2012.  The issue, therefore, is “back-burnered” at least until that time, and employers are not required to post the notice on April 30, as previously scheduled. The New Massachusetts Transgender Equal Rights Law On November 23, 2011, Massachusetts Governor Deval Patrick signed into law "An Act Relative to Transgender Equal Rights." The new law, effective July 1, 2012, prohibits discrimination on the basis of "gender identity" in employment, housing, credit and lending, and makes violence against transgender individuals a hate crime.
